Australian Captured in Afghanistan
There is an Australian who has been arrested in Afghanistan for fighting for the Taliban. Do Americans here think that he should be tried by them or should he be handed over to Australia to deal with?
Under Australia law it might be hard to try him for treason as Australia has not declared war on Aghanistan. However he could possibly be tried under our Mercenary Act which means he could spend up to 14 years in jail.
Of course, if tried by Americans, he could face the death penalty.
However if the US get to try John Walker I think it is only just that Australia gets to try David Hicks.
