 NEW ATV REGULATIONS
NEW ATV REGULATIONS
Senate Bill 189, codified at NC 20-171. (Article 3 section 10C: Operation of All-Terrain Vehicles). Except as otherwise noted, the following takes effect
December 1, 2005, and will be enforced on the Uwharrie National Forest:
Prohibitions:
• Parent or guardian cannot knowingly allow:
Under age 8 to operate ANY ATV
Under age 12 to operate ATV of 70cc or larger
Under age 16 to operate ATV of 90cc or larger
Under age 16 to operate any ATV unless under the CONTINUOUS VISUAL SUPERVISION of a person over age 18
• NO CARRYING OF PASSENGERS unless the ATV was specifically designed to carry a passenger.
• Knowingly selling or offering for sale any ATV to anyone intending to use the ATV in violation of the age restrictions.
• ATV operators MUST WEAR A HELMET AND EYE PROTECTION meeting DOT motorcycle safety standards.
• CANNOT OPERATE UNDER INFLUENCE OF ALCOHOL or drugs including prescription drugs which impair vision or motor coordination.
• CANNOT OPERATE ON A PUBLIC STREET OR ROAD except to cross directly. This includes FOREST SYSTEM ROADS.
• Cannot operate on a limited access highway.
• CANNOT OPERATE RECKLESSLY (endanger persons or property).
• Cannot operate from one half hour after sunset to one half hour before sunrise without working head light and tail light.
• Operators born on or after January 1, 1990 must have completed, and MUST HAVE IN THEIR POSSESSION the certificate for, an ATV safety course approved by the ATV Safety Institute.
• ATV must have brakes, muffler, and spark arrester in good working order. Spark arrester must meet USFS specifications.
